Gift Card Terms of Service

The following Terms of Service (“Gift Card Terms”) govern the purchase, use, and redemption of digital and physical gift cards (“Gift Cards”) issued by MADEXPRO (referred to as “we,” “us,” “our,” or the “Company”) for use on www.madexpro.ca or any associated websites, apps, or physical locations operated by the Company.

By purchasing, receiving, or using a Gift Card (including any titled/branded cards, eg. ACE CARD) you agree to be bound by these Gift Card Terms, as well as our general Website Terms of Use and Privacy Policy.

1. Nature of Gift Cards

  • Gift Cards are prepaid stored-value cards and represent a prepaid payment method only.
  • Gift Cards are not debit cards, credit cards, or charge cards.
  • Gift Cards do not constitute a checking, savings, or deposit account.
  • No interest, dividends, or other earnings will accrue on Gift Card balances.

2. Purchase of Gift Cards

  • Gift Cards may be purchased through our website, mobile app, or authorized third-party partners.
  • Payment for Gift Cards must be made in full at the time of purchase using an accepted payment method.
  • All Gift Card sales are final.

3. No Refunds or Cash Redemption (Non-Refundable)

  • Gift Cards are non-refundable and cannot be redeemed or exchanged for cash (except where required by applicable law in certain jurisdictions, and only to the extent required by such law).
  • No refunds will be provided for Gift Cards under any circumstances, including but not limited to lost, stolen, damaged, or unused Gift Cards.

4. No Expiration Date

  • Gift Cards do not expire and have no dormancy, inactivity, or service fees.
  • The balance on a Gift Card will remain available for the entire lifespan of the Company and its brand.

5. Risk of Loss & Closure of Business

  • The risk of loss and title for Gift Cards passes to the purchaser upon electronic transmission or physical delivery of the Gift Card.
  • If the Company ceases operations, permanently closes its business, files for bankruptcy, or otherwise discontinues the brand under which the Gift Card was issued, any remaining balance on Gift Cards will not be refunded, redeemed for cash, or transferred. Gift Card holders will have no further claim to the unused balance.

6. Use and Redemption

  • Gift Cards can only be redeemed for purchases of goods and services on [www.madexpro.ca] or at participating physical locations (if any).
  • Gift Cards (including ACE cards) cannot be used to purchase other gift cards.
  • ACE Cards cannot be used to purchase discounted or on sale items.
  • Gift Cards may not be resold, transferred for value, or applied toward any credit or payment card balance.
  • The full value of the Gift Card must be used toward eligible purchases; any unused balance will remain on the Gift Card for future use.

7. Lost, Stolen, or Unauthorized Use

  • Treat your Gift Card like cash. We are not responsible if a Gift Card is lost, stolen, destroyed, or used without your permission.
  • We reserve the right to refuse to honor a Gift Card if we reasonably believe it was obtained or used fraudulently or in violation of these terms.

  • You may check your Gift Card balance at any time by visiting your account profile or contacting customer service at madexpro@protonmail.com

9. Limitation of Liability

  • TO THE FULLEST EXTENT PERMITTED BY LAW, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
  • IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE A GIFT CARD.

10. Changes to These Terms

  • We reserve the right to modify these Gift Card Terms at any time. Changes will be posted on our website and will apply to Gift Cards purchased after the effective date of the change. Continued use of a Gift Card after changes are posted constitutes acceptance of the modified terms.

11. Governing Law

  • These Gift Card Terms shall be governed by the laws of [Your State/Province and Country], without regard to conflict of law principles.
